These terms and conditions are a legally binding agreement between Ho-ost Internet Solutions Limited, (“Ho-ost”, “Our”, “Us”) and any party utilizing our services (“Client”, "Customer", “You”, "Your"). By using any services offered by Ho-ost, you agree to be bound by this agreement. These Terms were last amended January 2nd, 2018.
a. To use services with Ho-ost, you are required to provide correct and up to date account information. This includes, but is not limited to: your full legal name, company name (if applicable), billing address, phone number, and email address. If you are suspected of using false information, you may be required to submit identification documents.
b. Before any services are provisioned, your account information will be checked against multiple fraud registries. All fraudulent orders will be denied and refunded if payment is already made, and your account will be permanently closed.
a. Ho-ost provides Shared and Reseller Hosting in two locations and are subject to local laws. To keep your Shared or Reseller Hosting active, you must upload a web page within the first 14 days of purchasing your package. You cannot use our Shared or Reseller Hosting as a file storage service, and there must be a purpose for your website. Failure to abide by this may result in account suspension or termination.
b. By uploading files to your account, you agree that you have ownership (or permission of the owner) to distribute the content. Ho-ost is not HIPAA compliant. No private medical data should be stored on Ho-ost's servers. Failure to host permitted content will result in account termination and the files deleted.
a. Ho-ost provides Virtual Private Servers in the United States and are subject to local laws. The CPU cores advertised for our Virtual Private Servers represents that of a fair-share system. Ho-ost does not offer dedicated CPU cores on our Virtual Private Servers and there is a maximum usage limit of 75% per core.
b. Upon payment, you agree to all configurable options selected. User specified changes to configurable options may incur a one time or recurring fee detailed within the configurable options section of your service.
c. Ho-ost's servers or networks will not accept connections from unsecured systems. These include open relays, open proxies, open routers, or connections from systems that use dynamically assigned or residential IP addresses.
d. Ho-ost will not deliver email that contains a hex-encoded Universal Resource Locator (URL). (Ex: http://%6d%6e%3f/) and will reject messages with more than 100 recipients or messages with attachments that exceed 100MB.
e. Ho-ost will reject connections from servers that consistently generate a higher than 10% invalid recipient rate (i.e. over 10% of a sender's mailing list is destined for users that do not exist and reject connections from senders who are unable to accept at least 90% of the bounce-return messages (mailer-daemon failure/error messages) destined for their systems.
f. Complaints and/or blacklists from sources deemed reasonable credible by Ho-ost will be used as a basis for refusing connections from any mail server. Ho-ost will make commercially reasonable attempts to provide communications to the technical contact of record who may be in violation of Ho-ost's policies.
h. You cannot use Ho-ost's servers for malicious reasons, such as: DDoSing, spam, installing nulled software, tor applications, hacking/cracking and will be terminated if found doing so. You cannot use Ho-ost's servers to host bitcoin pools or heavy-usage game servers. Ho-ost does not permit the use of our servers for email marketing (spam). If a client is found to have blacklisted their IP, they will be terminated and their account closed.
i. Pornography is permitted on our network, so long as it complies with United Kingdom and United States law. All pornography must comply with 18 U.S. Code 2257, must depict consenting adults, and must not depict any animals. Any violation of these provisions will be forwarded to law enforcement agencies.
j. Ho-ost may offer unmetered bandwidth on certain accounts. On these accounts, a bandwidth cap will not be placed on your service. This is "Fair Share" bandwidth, and is subject to some restrictions. On a Shared or Reseller account, if bandwidth usage is found to exceed 1TB, an investigation will be performed to find the cause of the excessive bandwidth usage. We do not offer unmetered bandwidth on our Virtual Private Servers.
a. Our Shared and Reseller hosting services offer a weekly backup. A copy of your websites data is saved to a separate backup server. You can request a copy of a backup via support ticket. If you would like daily backups, there is an additional fee which can be found in the product addons page. Otherwise, it is the clients responsibility to acquire their own backups outside of the monthly backup cycle.
b. Our Virtual Private Servers offer zero backups. It is the clients full responsibility to backup any data required from their Virtual Private Server.
a. You agree to provide the appropriate payment to Ho-ost for any services you have purchased in advance of period of which your services are active. You agree that until canceled, your services will continue to be billed on a recurring basis. You agree to provide payment on time for said services. Ho-ost will automatically generate an invoice prior to your due date, and you have until the due date to make payment. Failure to make payment on time will result in automatic account suspension and gives Ho-ost the right to terminate your account.
b. Ho-ost offers the ability to deposit into your account credit, to automatically pay for future invoices. It is also possible that account credit is given for SLA refunds, or because of over payment on an invoice. Account credit is nontransferable and cannot be redeemed for cash or refunded and can only be used to purchase Ho-ost services. If your account is closed, you agree to forfeit your credit balance.
c. Ho-ost has a zero tolerance policy on Paypal disputes. If you open a Paypal dispute/chargeback, we will automatically suspend your hosting package pending investigation. You may also be charged a $15 fee for opening a Paypal dispute.
d. Ho-ost reserves the right to adjust the price of any Ho-ost product to new clients at any time with or without notice. Ho-ost will not change the price of any existing service unless the service was upgraded or downgraded upon client's request and approval.
a. Ho-ost reserves the right to cancel your service(s) without renewal when your billing period is complete. You can request cancellation via our client panel, for either immediate, or end of billing period. Immediate cancellation means that your service will be terminated within 24 hours.
b. Ho-ost will provide a refund if you are not completely satisfied, or have changed your mind within 30 days. Our money back guarantee is only eligible for: Shared Hosting, Reseller Hosting & Virtual Private Servers. Our money back guarantee is NOT eligible for additional IP addresses, domain registrations of software licenses.
a. Client agrees to use all Ho-ost services and facilities at your own risk. Ho-ost specifically disclaims all warranties of merchant ability and fitness for a particular purpose. In no event shall Ho-ost be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages.
b. Client agrees that it shall defend, indemnify, save and hold Ho-ost harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Ho-ost, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Ho-ost against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with Ho-ost's server.
c. Ho-ost reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Ho-ost's server. Ho-ost shall be the sole judge of what violates this Policy.
a. Ho-ost reserves the right to change our Terms of Service, Acceptable Usage Policy or Service Level Agreement with or without prior notice.
b. Client is required to obide and continued use of our website and services will be considered your acceptance of the updated Terms of Service.
